Adam acted for a cyclist who had been knocked off his bike by a car. The case had previously been abandoned by another firm of solicitors after four independent witnesses blamed the cyclist and said he had gone through a red light.

Adam reviewed the evidence in detail and examined the traffic light sequencing. This helped show that the situation was not as straightforward as it first appeared, and that the driver must also have gone through at least an amber light. The case eventually settled on a compromised basis, with the client receiving £5,200.

Looking deeper when the evidence seemed stacked against the cyclist

Cycling accident claims are not always straightforward, especially where liability is disputed. In this case, our client had already been told by a previous firm of solicitors that they would no longer pursue the claim. Four independent witnesses had blamed him for the accident, saying he had gone through a red light before being knocked off his bike by a car.

Adam took a fresh look at the case. Rather than accepting the witness evidence at face value, he reviewed the traffic light sequencing to understand what must have happened at the junction. That review showed that the driver of the car must also have passed through the lights on at least an amber signal.

This changed the position of the claim. Although liability remained disputed, Adam was able to challenge the original assumptions and progress the case towards a compromised settlement. The client recovered £5,200 and was extremely thankful that Adam had believed in him when the witnesses, the driver and his previous solicitors had not.
