Cyclist awarded over £10,000 after roadworks caused shoulder fracture

Adam acted for a cyclist who was riding along a service road in South Manchester when he suddenly came across roadworks around a slight bend. Unable to stop in time, he fell from his bike and fractured his shoulder.

The claim was initially investigated against the residents who had arranged the work, but further enquiries showed that responsibility lay with the independent contractor carrying out the roadworks. Court proceedings were issued and, after no response was received, judgment was entered. The court assessed the value of the claim at over £10,000.

When unsafe roadworks create a serious hazard for cyclists

Roadworks can be especially dangerous for cyclists when they appear suddenly, are difficult to anticipate, or leave little time to react. On a bike, there is far less protection and far less margin for error when the road ahead is obstructed.

In this case, our client was cycling along a service road in South Manchester when he came upon roadworks around a slight bend. He was unable to stop before reaching them, causing him to fall to the ground and suffer a fractured shoulder.

Adam investigated who was responsible for the works. Although the claim was initially directed towards the residents who had arranged for work to be carried out at their properties, enquiries showed that the builder was acting as an independent contractor and that responsibility lay with him.

Proceedings were commenced against the contractor. When no response was received, judgment was entered and the court assessed the cyclist’s claim at in excess of £10,000.
